Terms & Conditions

Last revised: October 24, 2026 · Please read carefully before using TrailMates or joining any outing.

Summary of Key Conditions

Participate at Your Own Risk

Outdoor activities carry serious, unavoidable risks. You assume all risks voluntarily.

Leaders are Peers, Not Guides

A Leader is a fellow user who is familiar with an area — not a professional, licensed, or certified guide.

No Medical Training or Advice

No medical advice, first aid, or safety guarantees are provided by Leaders or TrailMates.

Liability Release

Neither the Leader nor TrailMates is liable for any injuries, losses, property damage, or user disputes.

1. Acceptance of Terms & Eligibility

By creating an account, browsing, posting, or joining an outing through TrailMates (the “App”, “we”, “us”, “our”), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not access or use the App.

You must be at least 18 years of age and legally capable of forming a binding contract to create an account, use the App, or participate in any outing organized through the App.

2. Platform Service Only

TrailMates is an online communications and networking platform that enables individual users to connect and independently arrange informal outdoor outings. TrailMates is not a tour operator, outfitter, guide service, educational institution, travel agency, or transportation provider.

We do not organize, supervise, direct, control, conduct, or monitor any outings. We do not employ, train, certify, license, background-check, or vet any users who post, host, or lead outings (“Leaders”). Any Leader or participant is an independent third-party user and is not an agent, employee, joint venturer, or representative of TrailMates.

3. Nature of Outing Leaders

A user who posts or leads an outing is merely another user who claims personal familiarity with a specific trail or area.

No Professional Status: A Leader is not acting as a professional guide, instructor, coach, park ranger, mechanic, medic, or emergency responder. Choosing to navigate a route with a Leader does not make them a qualified, insured, or licensed guide.

No Duty to Inspect or Warn: Leaders have no duty or obligation to scout, inspect, maintain, mark, or clear any trail, nor do they have a duty to warn participants of hazards. Outdoor conditions change rapidly due to weather, erosion, fallen debris, closures, wildlife, and traffic.

Personal Responsibility: You are solely responsible for evaluating your own fitness and skill level, selecting appropriate equipment, navigating routes, and making independent safety decisions on the trail.

4. No Medical Advice or Emergency Response

Neither TrailMates nor any Leader provides medical advice, first-aid services, medical diagnosis, or safety guarantees. Nothing contained in the App or communicated by a Leader should be construed as health or safety advice.

You are solely responsible for consulting a qualified healthcare professional regarding your physical fitness and health conditions before participating in any outing. Outdoor activities are physically demanding and frequently take place in remote settings where emergency medical response and communication services may be significantly delayed or unavailable. You expressly acknowledge and accept these conditions and delays.

5. Assumption of Risk

You acknowledge that participating in outdoor activities — including but not limited to mountain biking, hiking, trail running, bikepacking, and horseback riding — has inherent and significant risks of property damage, serious bodily injury, permanent disability, and death.

These risks include, without limitation: high speeds; equipment failure; falls; collisions with vehicles, riders, pedestrians, or natural objects; severe or changing weather; hazardous terrain; exposure to elements; dehydration; altitude sickness; wildlife encounters; remote locations; and the negligence of other participants or third parties.

You knowingly, voluntarily, and expressly assume all risks associated with your use of the App and participation in any outing, both known and unknown, even if arising from the negligence of others or TrailMates.

You agree to obey all posted land rules and local laws, wear standard protective gear (such as helmets), carry appropriate emergency supplies, and refrain from operating gear or participating while under the influence of drugs or alcohol.

6. Release of Liability — Leaders

To the fullest extent permitted by applicable law, you hereby release, waive, and forever discharge any user acting as a Leader from any and all claims, demands, causes of action, costs, expenses, or liabilities for personal injury, wrongful death, property damage, or other loss sustained by you arising out of or connected to an outing, including claims arising from the Leader's own negligence, route selection, guidance, or errors.

7. Release of Liability — TrailMates

To the fullest extent permitted by applicable law, TrailMates, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the App, interactions with other users, or participation in any outing.

TrailMates assumes no responsibility for:

  • The accuracy, completeness, or truthfulness of user profiles, ride histories, ratings, reviews, or trail descriptions.
  • The conduct, suitability, qualifications, or safety practices of any user or Leader.
  • The physical condition, legal status, safety, or accessibility of any trail, public land, or private property.
  • Disputes, altercations, or financial transactions between users.

Any dispute between you and another user is strictly between you and that third party. You hereby release TrailMates from any and all claims, demands, and damages arising out of or in any way connected with such disputes.

8. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. TrailMates does not warrant that the App will be uninterrupted, timely, secure, or error-free, or that information provided by users or third parties is accurate or reliable.

9. Payments and User Transactions

Any financial transactions, outing fees, or shared costs arranged between users (including payments to Leaders for expenses, shuttles, or permits) are handled directly between users or via third-party payment processors. TrailMates is not a party to these transactions and bears no responsibility for refunds, payment processing errors, cancellations, disputes, or tax compliance.

10. User Conduct and Compliance

You agree to use the App responsibly and lawfully. You agree that you will:

  • Provide truthful and accurate information in your profile and listings.
  • Comply with all applicable federal, state, and local laws, land management rules, park regulations, permit requirements, and trail closures.
  • Respect private property, wildlife, environmental regulations, and other trail users.

11. Indemnification

You agree to defend, indemnify, and hold harmless TrailMates, its parent companies, subsidiaries, affiliates, partners, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the App, your participation in any outing, or your conduct toward other users.

12. Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. We will notify users of material updates by changing the “Last Revised” date at the top of these terms or through an in-App notification. Your continued use of the App following the posting of revised Terms constitutes your acceptance of the changes.

13. Governing Law and Severability

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App operator is incorporated/headquartered, without regard to its conflict of law principles. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

By using TrailMates or joining an outing, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, including the assumption of risk and the releases of liability above.
